DBH Family Lawyers are well positioned to assist you with any issue relating to Child Support.
Under current legislation, all parents have a duty to maintain their child – regardless of who is the child’s primary carer. The Child Support Agency has been established by the Australian Government to assess the amount of Child Support payable by each parent.
A Child Support Estimator is available on the Child Support website and can provide you with estimates of what you need to either pay or receive. Please note, the Child Support Estimator can only provide you with an estimate and modification of the Child Support Assessment is possible under exceptional circumstances.
Private Child Support Agreements can be established between both parties in lieu of CSA assessments. A parent or child may make an application to the Court in the case of children above the age of 18.
Child Support Payments
A child support payment is an amount of money transferred between separated parents to foster the raising and wellbeing of their child and children. Child support is payable whether you live in Australia or overseas.
Payments can be transferred privately, through the Department of Human Services or a registered agreement or court order. Payments are based on an assessment of your adjusted taxable income from the previous year.
If this is no longer an accurate reflection of your current income, you may be eligible to provide an estimate of your income for the current financial year. You can always update these details if your circumstances change.
Seek Legal Advice
If you are required to pay or receive child support, seeking legal advice is recommended to ensure the amount payable is suitable and to make sure you are supported throughout the initial and ongoing process.
At Duncan Basheer Hannon we understand establishing child support payments is a complex procedure, but one that is also extremely important. We ensure that you and your former partner enter an agreement that is legally binding and most importantly, the best outcome for your child.
