Duncan Basheer Hannon is investigating a class action against TAFE on behalf of all TAFE students affected by recent findings from the Australian Skills Quality Authority.

It is apparent from ASQA reports that the qualifications that students enrolled, paid and studied for have not been delivered by TAFE.  

Many students will need to pay additional fees and repeat course work to obtain their qualifications. This will result in delays in obtaining higher paid employment in their industry of choice. Some students will be forced to attend private Registered Training Organisations (RTOs) at their own cost as a result of the failure of TAFE.

The class action will claim for:

  • Reimbursement of fees paid for courses;
  • Loss of income and income earning potential;
  • Reimbursement of additional costs associated with further study or repeated course work.

The class action will be undertaken on a “no win, no fee” basis.  

For an individual, taking on the South Australian Government and TAFE would be a difficult and costly process. If hundreds and perhaps thousands of students who have been affected join together in a class action, we are confident that a favourable and sensible outcome can be achieved.
