Should you still see a lawyer if you have a claim with Return to Work SA?

A workplace injury can be a life-changing event. It can be a stressful time for the person injured as well as their family. 

If you’ve been injured at work, there are many questions you may have, and one of the first you may ask yourself is, do I need a lawyer, if I have a Return to Work Claim?

When to see a lawyer about a workplace injury 

In our experience, injured workers come to see our team for legal advice in the following circumstances.

  1. When the insurer makes a decision that the injured worker does not agree with. This can be a particularly stressful time, the most common decisions that an injured worker does not agree with, is a rejected claim, the amount of income support that they are to receive, or whether a certain medical procedure is necessary. We will be able to assess if the decision made by the insurer is wrong and be able to tell you what your options are in challenging this decision. It is important to know that there are strict time limits that apply in challenging a decision from an insurer.
  2. The way that they have been treated by the insurer or their employer. We will be able to tell you about your rights and entitlements. In some circumstances, it may not be possible for you to return to your pre-injury employer because of your injuries. If this is the case, we will be able to assist you in exploring what other options are available to you.
  3. Throughout the injured worker’s permanent impairment assessment process, the assessment that determines how much monetary compensation, if any, an injured worker will receive because of their workplace injury. This happens near the end of an injured worker’s claim when their injury has stabilised. An injured worker is only allowed to have one assessment of their injury. We will be able to guide you through this daunting process and ensure all your workplace injuries are assessed by the right doctor.
