Investigating a medical negligence claim – what should I expect?

Seeing a lawyer can be an intimidating experience.  Being prepared and knowing what to expect can make that experience easier.  If you have been injured as a result of medical treatment, we can assist with investigating a medical negligence claim.

In order for us to provide you with advice as to whether a medical negligence claim should be investigated, we require a history of the events leading up to, during and following the medical treatment that caused your injury.  One of our experienced medical negligence specialists will meet with you to record a history.  You should bring to the appointment any documents you have relating to the treatment and your injuries for us to consider.

It will be necessary for us to review the medical and/or hospital records relating to the medical treatment that caused your injury.   You do not need to obtain these records.  We can obtain the records for you.

To be successful in a medical negligence claim, it is necessary to obtain an opinion from a medical expert confirming that your treatment provider was negligent and their negligence caused your injuries We have access to a number of experts that are appropriately qualified and are experienced in providing reports addressing whether a treatment provider has acted negligently.  We will put together the necessary documents to be sent to an appropriate expert so that an opinion can be obtained.

If the expert provides an opinion that is supportive of a claim in negligence against your treatment provider and that your injuries were caused by that negligence, we will assist you in putting together a claim for compensation.
