How will the new workers compensation laws affect me?

If you had a previous workers compensation claim under the Workers Rehabilitation and Compensation Act (injuries on or prior to 30 June 2015), then the new Return to Work Act will affect you.

The new Workers Compensation Scheme came into effect on 1 July 2015 and is applicable to all workers on the Scheme in South Australia despite the fact that you may have an existing or old injury.

There are significant implications to the new Scheme which includes a reduced ability to claim medical expenses and weekly payments in addition to restrictions on lump sum entitlements for permanent impairment.

It is important that you contact a solicitor to discuss how the new Scheme may affect you and what, if any, entitlements you will have ongoing.

In particular, workers need to be aware that if they are not in receipt of weekly payments as at 1 July 2015, their medical expenses may cease on 30 June 2016, depending on your current circumstances and level of impairment.
